CIVIL AND COMMERCIAL LITIGATION

Our team advises and represents French and international companies operating across a wide range of industries before civil and commercial courts. We place particular emphasis on developing a thorough understanding of our clients’ business sectors and the markets in which they operate.

We also assist clients at the pre-litigation stage in connection with expert proceedings, particularly court-appointed expert investigations, across a variety of fields, including transport, information technology, telecommunication, healthcare, finance and accounting. In addition, we have developed extensive experience in ex-parte pre-litigation discovery measures pursuant to Article 145 of the French Code of Civil Procedure.

Mindful of both legal risk and cost efficiency, we seek, whenever appropriate, to implement tailored pre-litigation strategies and to promote alternative dispute resolution methods, including mediation and conciliation, whether conducted under court supervision, through institutional frameworks or on an ad hoc basis.

Where an amicable resolution is in our clients’ best interests, we assist them in negotiating and drafting settlement agreements.

  • Representing, jointly with Delaware counsel and pro hac vice, a French company listed on NASDAQ before the Delaware courts in a dispute with a company listed on the Tokyo Stock Exchange concerning the breach of a memorandum of understanding
  • Representing a leading French telecommunications operator in numerous court proceedings brought by banks in connection with spoofing fraud
  • Representing a French pharmaceutical manufacturer in unfair competition proceedings against a competitor following the unlawful solicitation of part of its production team, including Article 145 proceedings followed by proceedings on the merits
  • Representing a member of the Qatari royal family in a dispute with a former franchisor concerning the termination of a franchise agreement and the validity of certain of its provisions
  • Advising a French semiconductor company in the French tech sector in a pre-litigation dispute with a major competitor arising from the poaching of one of its operational teams
  • Advising a leading manufacturer of power converters on the drafting and negotiation of a distribution agreement for the Russian market
  • Representing the Indian subsidiary of a leading French nuclear group in a dispute concerning the breach of an exclusivity clause and the wrongful termination of a distribution agreement
