Our latest commentary published by LexisNexis analyses a decision rendered by the Paris Court of Appeal on 4 April 2023 in Bunge Geneva S.A. v. BZ Grains S.A.S., concerning so-called “pathological” arbitration clauses.

The decision provides useful guidance on the criteria used to assess the validity and effectiveness of an imperfectly drafted arbitration clause, while reaffirming the French courts’ arbitration-friendly approach to international arbitration.
