Cartier Meyniel Secures the First Victory under the Naegelen Act
Cartier Meyniel successfully represented a telecommunications operator in litigation arising from a bank adviser impersonation fraud involving caller ID spoofing.
In an obiter dictum, the court held that the terminating operator (the operator involved in the proceedings) cannot be held liable for transmitting a telephone call where the call has been duly authenticated by the originating operator.
This is the first reported judicial decision applying the Naegelen Act.
